Terms of Service

These Terms of Service ("Terms") govern your access to and use of PixEarn Store (store.pixearn.com), operated by PixEarn ("we," "us," or "our"). By using PixEarn Store — whether as a seller (creator) or a buyer — you agree to these Terms. If you do not agree, do not use the platform.

1. Acceptance of Terms

By creating an account, listing a product, or making a purchase on PixEarn Store, you confirm that:

You are at least 18 years old.
You have the legal capacity to enter into a binding agreement.
You will comply with these Terms and all applicable laws.

2. Accounts

2.1 Seller Accounts

Sellers must hold an active PixEarn account at pixearn.com with a completed profile and at least 2 quality public posts. See the Seller Agreement for additional seller-specific terms.

2.2 Buyer Accounts

Buyers may check out using just an email address. A lightweight buyer account is created to store your purchase history and enable re-downloads. You can upgrade to a full PixEarn creator account at any time.

2.3 Account Security

You are responsible for maintaining the security of your account credentials. Notify us immediately at support@pixearn.com if you suspect unauthorised access.

3. Products and Listings

3.1 Digital Products Only

PixEarn Store is a digital-only marketplace. Sellers may list downloadable digital goods such as art files, presets, templates, e-books, and similar content.

3.2 Pricing Limits

Products must be priced between $0.50 and $499.00 USD.

3.3 Accuracy

Product listings must accurately represent the content being sold. Misleading descriptions, titles, or preview images are prohibited and may result in listing removal.

3.4 Availability

We do not guarantee that any product will remain available. Sellers may deactivate or remove their products at any time, but existing buyers retain access to files they have already purchased.

4. Purchases and Payments

4.1 Payment Processing

Payments are processed by Razorpay. By making a purchase, you also agree to Razorpay's terms and conditions. PixEarn does not store your card number or CVV.

4.2 Currencies

Product prices are displayed in USD. Razorpay may convert and charge you in your local currency at the exchange rate applicable at the time of payment.

4.3 Refund Policy

All sales are final. Because digital products are delivered immediately upon payment, we do not offer refunds except where required by applicable consumer protection law. If you believe you received a defective or materially different product, contact us at support@pixearn.com within 7 days.

4.4 Download Limits

Downloaded files may be subject to limits (e.g., number of downloads or expiry period) set by the seller or the platform.

5. Acceptable Use

You agree not to:

Use the platform for any unlawful purpose or in violation of these Terms.
Attempt to reverse-engineer, scrape, or copy the platform or its content in bulk.
Circumvent, disable, or otherwise interfere with security-related features.
Upload files containing viruses, malware, or harmful code.
Impersonate another person or entity.
Use the platform to send spam or unsolicited communications.
Resell, redistribute, or sub-license purchased digital products without the seller's explicit written permission.

6. Content and Intellectual Property

6.1 Seller Content

Sellers retain ownership of their products and grant us a limited licence to display, distribute, and deliver products through the platform. Sellers grant buyers a personal, non-exclusive, non-transferable licence to use purchased products for their own non-commercial purposes unless a product specifically states otherwise.

6.2 Platform Content

All platform software, designs, logos, and text (excluding seller content) are owned by PixEarn and protected by intellectual property law. You may not copy or redistribute them without our written permission.

6.3 Copyright Infringement

If you believe content on PixEarn Store infringes your copyright, contact us at support@pixearn.com with details of the infringing content and your ownership claim. We will investigate and take appropriate action.

7. Prohibited Content

The following content is prohibited on PixEarn Store regardless of plan:

Content that is illegal under Indian law or the laws of the buyer's country.
Content that sexually exploits or depicts minors in any way.
Content that incites violence, hatred, or discrimination based on race, religion, gender, sexual orientation, disability, or other protected characteristics.
Stolen, plagiarised, or fraudulently represented intellectual property.
Executable files or software designed to harm, spy on, or exploit users.

Violation of this section will result in immediate account termination, potential reporting to law enforcement, and forfeiture of any pending payouts.

8. NSFW Content

Adult-oriented or not-safe-for-work (NSFW) content is permitted only for sellers on the Growth or Elite plan who have explicitly enabled the NSFW flag on their product. NSFW content must comply with all applicable laws and must involve only adults who have provided documented consent. We reserve the right to remove any NSFW content that violates these requirements.

9. Platform Availability

We strive to maintain platform availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages that temporarily affect availability. We are not liable for losses arising from downtime.

10. Disclaimers

PixEarn Store is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant the accuracy, completeness, or suitability of any product listed on the platform. Buyers purchase products at their own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, PixEarn and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim arising from your use of the platform is limited to the amount you paid us in the 30 days preceding the claim, or $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless PixEarn and its affiliates, officers, and employees from any claim, loss, liability, or expense (including legal fees) arising from:

Your breach of these Terms.
Your products infringing third-party intellectual property.
Any content you post, upload, or sell through the platform.

13. Termination

We may suspend or terminate your access to PixEarn Store at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. You may close your account by contacting us at support@pixearn.com.

Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in India. We encourage you to contact us first to resolve any dispute informally before initiating formal proceedings.

15. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on this page with a revised date and, for material changes, notify registered sellers by email at least 14 days in advance. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
